1. Agreement, eligibility and accounts
These Terms & Conditions ("Terms") are a contract between you and BeWell'r, LLC ("BeWell'r," "we," "us") for use of the BeWell'r mobile app, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our End User License Agreement. If you do not agree, do not use the Service.
Organizations. If you use the Service through a school, employer or other organization, that organization may have its own agreement with us and may manage parts of your account, as described in our Privacy Policy.
Your account. You agree to give accurate information, keep your login details secure, and tell us promptly at support@bewellr.com if you think your account has been accessed without permission. You are responsible for activity on your account. One person per account.
Price. The Service is currently free to download and use. If we introduce paid features, we will tell you the price and terms before you are charged.
2. Health, safety and Welliam
Not medical advice. BeWell'r is a wellness and habit-building program. It is not a medical device and does not diagnose, treat, cure or prevent any disease or mental health condition. The SWPS assessment measures wellness behaviors; it is not a clinical or diagnostic test. Mindfulness and CBT-based micro-modules are for general self-care and are not a substitute for therapy or professional care. Always talk to a qualified health professional about your health, and before starting a new exercise, nutrition or wellness routine.
Not a crisis service. If you are in crisis or thinking about harming yourself or others, do not rely on the Service. In the US, call or text 988 (Suicide & Crisis Lifeline) or call 911. Outside the US, contact your local emergency number.
Welliam, the AI coach. Welliam's responses are generated by artificial intelligence. They may be inaccurate, incomplete or unsuited to your situation, and they do not come from a human professional. Use your own judgment and do not rely on Welliam for medical, psychological, legal or financial decisions. You agree not to use Welliam to create harmful, illegal or abusive content.
Your choices. You decide which goals, activities and suggestions to follow, and you do so at your own risk.
3. Community, your content and connected people
Community rules
Community features (BeWell'r Connect) are for encouragement. We have zero tolerance for objectionable content or abusive users. You agree not to post or send anything that:
- Harasses, bullies, threatens or demeans anyone
- Is hateful, sexually explicit, violent or otherwise objectionable
- Encourages self-harm, disordered eating or other dangerous behavior
- Shares someone else's personal information without their permission
- Is spam, advertising or impersonation
- Is illegal or infringes anyone's rights
You can report content and block users from within the app. We review reports, remove content that breaks these rules, and may suspend or remove users who post it. Community is moderated, but we do not review every post before it appears.
Your content
You own the content you create, such as reflections, journal entries and Community posts ("Your Content"). You give BeWell'r a worldwide, non-exclusive, royalty-free license to host, store, process and display Your Content only as needed to operate and improve the Service and as described in our Privacy Policy. Private content such as journal entries stays private to you except as described in the Privacy Policy. This license ends when you delete Your Content or your account, except for Community posts others have already interacted with and backups kept for a limited time.
You are responsible for Your Content and confirm you have the right to share it.
Support Persons and organizations
If you link a Support Person or join through an organization, you agree they may see the information described in our Privacy Policy. You can remove a Support Person at any time. If you are a Support Person, you agree to use a linked user's information only to support their wellbeing, to keep it confidential, and to link only with users who have agreed. Organization administrators agree to use dashboards only for legitimate wellness purposes and in line with their own legal obligations.
Feedback
If you send us ideas or feedback, we may use them without any obligation to you.
4. Ownership, ending use and legal terms
Our property. The Service, including the BeWell'r name and logo, Welliam, the SWPS (© Craig M. Becker, Ph.D.), and all content, software and design we provide, belongs to BeWell'r or its licensors and is protected by law. Your right to use the app itself is set out in our End User License Agreement.
Acceptable use. You agree not to misuse the Service, including by interfering with its security, scraping or harvesting data, accessing other users' accounts, or using it for any unlawful purpose.
Suspension and termination. You can stop using the Service and delete your account at any time in Settings. We may suspend or end your access if you break these Terms, if required by law, or to protect users or the Service. Sections that by their nature should survive (such as ownership, disclaimers and limits of liability) continue after termination.
Changes to the Service and Terms. We may add, change or remove features. We may update these Terms and will notify you in the app or by email before material changes take effect. Continuing to use the Service after that means you accept the updated Terms.
Disclaimer. The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or that it will produce any particular wellness outcome.
Limitation of liability. To the fullest extent allowed by law, BeWell'r and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the Service.
Indemnity. You agree to cover BeWell'r against claims arising from Your Content or your breach of these Terms, to the extent allowed by law.
General. These Terms, the Privacy Policy and the EULA are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. Our failure to enforce a term is not a waiver. You may not transfer these Terms; we may transfer them as part of a merger or sale.
